For those who don't already know...
Lancelin is being closed down!!! Unfortunately sum prick has decided to sue the council / shire in charge of the area. Apparently another reason is the shire cant find the insurance to cover the land so yeah. As you might realise this going to screw the town of lancelin when they no thoroughfare. And guess what that leaves only gnangara and pinjar the only legal riding left in Perth.
if you want more riding areas, let ur local mp know what is going on, otherwise this sport is gonna become underground! _________________

Yes and with the handfull of over-publicized deaths offroad in the last few weeks there has been a lot of uninformed comment on recreational rideing. The moronic attitude of those with in the offroad community is doing nothing to help our cause either. _________________ 05 400ex

| Quote: | October 17 - Judgement in Lancelin Liability Case
The decision in the case that triggered Gingin Shire's move to close the Lancelin ORV area has been handed down.
Judge Keen found Gingin Shire partially liable for the accident, primarily due to the lack of adequate warning signage about the inherent dangers of the areas, particularly the unpredictable drop-offs that can occur through wind action on the dunes.
Importantly, Judge Keen did not find that Gingin Shire should have regularly inspected the dunes, or identify particular dunes that were especially hazardous, or place signs around the dunes to warn of specific dangers or exclude the public from the area.
On the last point, Judge Keen said it is "probably safer to have these activities being carried on in a specific area rather than being conducted by members of the public on an ad hoc basis".
This judgement strongly supports the RTRA view that Gingin Shire can obtain the protection from lawsuit that it needs simply by ensuring that there is more adequate signage, and without needing to close the area.
RTRA has again written to the Shire CEO voicing opposition to the proposed closure. A submission will also be made to the Off Road Vehicle Advisory Committee which is currently assessing Gingin Shire's request.

Bad news about Lancelin
Just joined RTRA - hope we can stop this cancer spreading.
Local landowner down here who owns a large portion of Wiley Bay dune area told me local shire has asked him to fence off his property due to fear of litigation - has no intention of doing this.
If you crash your car into a power pole you can't sue the shire for driving where you shouldn't what makes a dune drop off different? _________________ Raptor 700 |
